I am maintaining website which consists of videos from youtube. My site is dedicated to Serials. Will it create any legal issues? Or do I need to get any copyrights from the user who are uploading videos? Do I have to get any permission from youtube regarding this? Many Thanks for your answer.
I don't see a reason why you should get into trouble.. if someone might, it would be the original youtube uploader. So chill out and do what you do!
Well they supply the URL or code for sharing. If video owner does not want to share, they can enable You Tube viewing only. They also provide movie editors. For example I made this in about 10 minutes. Yes I know Holly Wood is not in my near future.
Yes, you could get into trouble if you are displaying videos that were not uploaded by the copyright holder. In most cases, they will simply get it removed from youtube and/or go after the uploader.... but they could also sue you and/or file a DMCA with your host and the major US search engines.
Incorrect. When uploading youtube videos, you have the option to choose the type of license. Also by default you aren't allowed to upload copyrighted material. Under Youtubes business model, it is the responsibility of the uploader. Going by your statement, then even Youtube could be sued, which isn't the case. Its the original uploader's responsibility and no one else's.
LOL, WRONG. A site owner is responsible for the content they display on the site. If someone uploads copyrighted material to youtube and allows embedding, they can only give permission if they have the legal rights to do so. Youtube HAS been sued a number of times. They have already spent over $100,000,000 (yes, that's one hundred million dollars) in legals fees in their Viacom case (which is still ongoing). The major difference in that case, is that Google is displaying "user-generated" uploads, not uploading the content themselves (which would give them no worthy defense). The OP can clearly be sued - there is absolutely no doubt about it.
The point is.. they would first go chase the original uploader.. and in the process, the video is automatically removed wherever it is embedded.
The point is, you were wrong and shouldn't be posting in the legal section when it is clear you don't have a clue.
Whatever dude... I'm yet to see a case of a webmaster being sued for youtube copyright infringement. And from the looks of it.. unless you are managing a really big portal, there is nothing to worry about.
Nothing to worry about? Have you ever been involved in an intellectual property lawsuit (I have, many times). Do you know that spending hundreds of thousands of dollars in legal fees is possible (I do). Do you know about Senate Bill 978? Didn't think so. http://www.infowars.com/embedding-youtube-videos-may-soon-be-a-felony/
Does this law has passed? Is it only for USA or worldwide? I am non-US resident and pretty sure still no such law has enacted in my country for the same. But as I am about to manage a site using the videos embedded from Youtube, will it create any problems further as youtube is registered in USA?
A. The law is not passed yet. And it will take time. B. Such kind of laws are practically impossible to enforce and will take years if not months to actually see it implemented. Case in point, the EU cookie law. They passed the law alright, but now what? Even the original people who drafted the law expressed obstacles towards implementing it. C. The article seems to speak only about the US. With the Internet being global, there are ways to circumvent this. Its a shame when people get caught up with copyright infringements, but just because a law has been proposed doesn't mean one has to just stop doing it. Its a matter of personal choice.
First and the most important point is you tube invites people to upload their videos. So if i upload my personal video which is not copyrighted, Can be acquired by youtube? No, I believe.
