Not always. If you are attracting lots of fraudulent clicks they will ban you straight away, without warning. If it's a more minor TOS violation, for example an ad placement or autosurf traffic issue, they usually warn you beforehand.

i dont really know how google tracks but i believe its cookies and ip address just dont click on your own links!!!
I just caught that message - Google usually call them 'invalid clicks' but fraudulent means the same thing. These are when a publisher tries to con the system by clicking on his/her own ads, asking someone else to do so or employing some sneaky cloaking/automated click technique.
I did receive a warning on a forum that I have. I was even surprise about it. The Forum had a Sex Talk section and it was in Spanish. As soon I received the warning I removed it from the forum. The e-mails stated that I had 3 days to correct it or else. Later that week I received another email thanking me for complying
