Hi, I am running a video porn site, and my dedicated server datacenter at germany & Netherland, not in USA. Do i still need to include the DMCA Notification Page and 18 U.S.C. Section 2257 compliance notice on my website? By the way, i am not a USA resident. Please advice. Thanks! Have a great day!
again same thing not applicable to you . if the vids are copy righted which they are anys you will definitely get DMCA notices cause they think they own the world depends on the laws where you live and the host , if the host is a good one from .NL you can just delete them or just tell them shove it
I suggest you get some real advise from a reptuable member or person with experience, because im pretty sure if you display pornograhic material you need to display the 18 U.S.C. Section 2257 compliance notice and also keep records of the individuals that appear on the website: name age, D.O.B, Address, the works. Born in the US or not you must comply.
Hi, Thanks for your kind advice. Let say if i get a DMCA letter, will i get sue? Or i just remove the content will be ok. Thanks. Rex
It's not technically true that they can do anything against you if you live in a certain country that doesn't have laws against this. Read up on your current laws of your country.
No, you are not from the US and your information is not stored in the US. As such, the Digital Millennium Copyright Act does not apply to you. Also, 18 USC 2257 does not apply to you either. USC stands for United States Code, and if you look at USC, you will see the act has to be committed by a person subject to the jurisdiction of the US. That does not include anywhere that is not a US Controlled Territory or state. Also, if you are an American living abroad the only way USC applies to you is if you are subject to the Military Extraterritorial Jurisdiction Act (MEJA; pronounced me ha) which is only military on active duty and dod contractors that are on official business outside the US. In summary, no, you are not subject to US Code, and as such, are not required to comply with it.
You're welcome. Just remember, you are still subject to the laws of the land you live in and the laws of the land your content is hosted in.
Hello hostlonestar, Thanks for your advices. "land your content is hosted in."? I just change a dedicated hosting company in USA, datacenter also in the USA too. Do i have the risk? I am not a US resident, but my server is located USA. Thanks, Rex
