I just read through the DCMA home page, and was curious if this is a loop hole. It states If i upload music to a server that means I have possession of the music on my personal computer. If i download it from a server outside of the US that means it is on my personal computer. What if i used a proxy to download music to, and upload from. Would this be legal since the music file is never on my personal computer and is just being transferred from one computer to another all of which are outside of the US?
Just because the servers are outside the U.S. does not mean you are not violating U.S. law. Further, the FTC has congressional approval to reach out beyond the U.S. borders to keep us safe: Summary of the US SAFE WEB Act Background: The Internet and electronic commerce know no boundaries, and cross-border fraud and deception is a growing problem for consumers and businesses in the U.S. and abroad. The US SAFE WEB Act provisions are needed to help the FTC to protect consumers from cross-border fraud and deception, and particularly to fight spam, spyware, and Internet fraud and deception. The key provisions are summarized below: Please see: ftc dot gov/reports/ussafeweb/Summary%20of%20US%20SAFE%20WEB%20Act.pdf[/url]
