I would appreciate iit if anyone who has filed a DMCA complaint, then succeeded, answer the following questions: 1. How long does it take? 2. Do i need a lawyer or money for it? 3. I want to report a blogspot blog and have no way to know the identity of the owner (site has no about page), could i sue Google instead? 4. What would i get out of it? Would there be some money involved? 5. Would there be some geography issues? Ex, i live in US and i want to file DMCA complaint from Asia I've already "Googled" and researched about DMCA but i need first hand information from someone who has already done so
No there is no money involved unless this went to a trial (thats your option) which would only happen if the user fought your DMCA complaint. I'll answer all your questions. 1. With google, probably 1-2 days 2. No, you need neither unless he fights the DMCA complaint and you decide to sue him. 3. Just report it at blogspot.com make sure (link http://www.google.com/blogger_dmca.html) 4. No, all that would happen in stage one is the content on the blog would be removed or deleted and there account would probably be deleted. 5. Why would you send the complaint from asia?....That doesn't make sense, your in America and so is blogger. So it is being done in the US. Just file the complaint with the link above make sure to include all the information as needed. Also, please don't send out fake DMCA's as if he is the owner he could sue you for some hefty hefty fines.
It is possible for you to sue someone for monies lost due to fraud, I've done it myself. However when it comes to sueing someone directly for monies in a different country it takes a lot more money plus it depends on their laws out there. MikeB67 cleared most of the things up though. Cheers, Andy
Yea mike hit it on the nose. If your server is in the United States delete the copyright file. If it is offshore you can basicly keep it with almost no worries.
I've only filed a DMCA complaint with Google once about this... when some joker in West Virginia (pretending to be a CPA) copied my entire CPA firm web site... This was kind of funny in a way. I'm the author of QuickBooks for Dummies so I talk that book up quite a bit on the web site and offer to give away the book for free to new clients, etc. This guy did the same thing. In the end, as I understand it, Google just removed his web site from SERPs for search terms that I provided and which led to his website. So this was pretty powerful if you think about. It was pretty easy to guess at the best 20 or 30 search terms and make sure the guy didn't show up in the SERP pages. If someone had copied hundreds of pages of content (which happened to be case in my situation) you still have the long-tail search terms you'll never guess... but you can pretty severely knock down the traffic. Anyone who has a clue should tread carefully if they've violated copyright laws and are subject to Google-DMCA-based retribution... Steve
How long does it took before Google has respond to your complaint? My problem was, he scraped by site's contents then divide the post into two posts and add a link source to my file. But he did this to a lot of my pages. I am inspired by you and I will finalize things before filing a DMCA complaint AS for everyone, thank you. All of you have been very helpful.
1st send the DMCA to the main hoster if they not reply send to ISP provider it will be more effective no need for lawyer or money,but u need to own that produce just send the report tp google with that blogspot name,but you cant find the owner details ya sure you can file any where in the world,but some coutries dont take care of DMCA
DMCA complaints are just that complaints about people abusing their 'Copyrighted' content while using your services I get many of them with my hosting business mostly from WHMCS or Jelsoft I just suspend the sites and tell them to either use a free alternative or buy a license and I make them show me that they will do that before I unsuspend them
