DMCA claim

    Hey

    Im running vps and one of the user got a claim for their site. my vps is supspended and i dont know what to do. i mail the owner of the script he used that i will remove the content. is that enough?


    the mail:

    This DMCA notice has been written and sent according to the guidelines set out by the DMCA within the jurisdiction of the United States of America.



    DMCA notice: XXX



    I am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.






    Link to infringing material on your site:XXXX

    Comments: This copy of XXXXX software is running without license, and thus illegally.



    I have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agents, or the law.



    The linked media above is being used without license, is the copyright property of XXXX. and thus is being broadcast illegally.



    Under penalty of perjury, I note that to the best of my belief the above information is entirely accurate.

    The infringing content must be removed. The owner of the copyright may take action against the website owner, but probably won't. Your host may have a policy of terminating hosting when this happens, or they may unsuspend your account - it's up to them. You need to contact your host.

    and ASAP - i lost loads of content this way when my host erased my account...

    You should do better than that,you can pleased the owner by offering him a sharing of profit with him.
    Or if he rejected your offer,then you should tear down the related content.
    But if you still want to keep the content,and you can do this legally by switching your server to offshore.
