digital contract

    Hi,

    I'm willing to make or use a digital contract for selling non-tangible goods. I have lost a case on paypal I could not prove I have sold a template. So from now on I would like the buyer to sign a digital contract that they state that they are aware of a purchase.

    What's the best safest way to get this done you reckon?

    There's really nothing digital that stands up legally, unless you can 100% prove that the person who agreed is the actual persona making the purchase, which is impossible.

    If you can get a signed receipt and a copy of their drivers license it will go a long way. The biggest thing you need to be able to do, is confirm that the buyer received the digital goods, and that what they received is exactly what was agreed upon.

    Well, i guess the answer is really simple. You use TOS (Terms of service) which stands for a contract, because when user accepts your terms when registering with you.

    You can later prove that the person is in your client list and he accepted the TOS.

    Solves my question partionally. That's for when you run a shop. But when you're just a freelancer. You don't have a page where people need to signup at first hand

    TOS dosent work when it come to a Paypal chargeback,
    You need some sort of proof that the customer received his merchandise/service.

    if you can fax them a copy of the contract and have them sign it you would be in the safe.

    Ok, thanks for the many replies, faxing is the most safe solution it seems however most people don't have a fax (outdated)

    many people have all in one printers, which fax... that's what I use, and have used w/ clients...

    Ok I think I'm gonna purchase a fax aswell, any ideas on how to find some digital contract samples online. For selling in-tangible goods (more specified: webdesigns and templates)
