Hello I have a typo of a popular lyric site and the domain gets decent traffic. The parking revenue is very low, so I was wondering if it would be clever to develope the site? regards Zinko
Well, if they find out and decide to go after you, it could cost you. Typo domains (generally) fall under 'confusing similarity' trademark law. If the domain of which yours is a typo is a trademark, bad idea.
The term, website, and subsequent branding on their part can in fact be trademarked. They don't necessarily have to though. All they have to do is pull up the internet archive to demonstrate "first use in commerce". All you are essentially doing is riding someone else's shirt tails and or idea. Whatever it is you do on your domain can and likely will have a direct impact on their business. Which in turn can, and likely will, create a range of legal issues for you. hope that helps, Nigel
And this is not only the name, it will be worst if you try to develop it as a lyrics website so the only way to do something is exactly trying with a non-music/lyrics related site to avoid legal issues, otherwise leave it parked.
