    I don't think they are a premium publisher - Alexa 700k+

This must be a premium publisher, for example take a look at the index page - do you see the huge google adsense ad in the middle?

Here is the code for it: http://dell-drivers.com/ads/index335.js

If this isn't, then wow.... the owner is really breaking the rules!

They have edited the code and added code in to fit in exactly with the rest of the website.

ehhh. I heard premium publishers get away with a lot.

This guy seems to do it left and right. First, confuse users by making it look like an actual important button of the site, 2nd change the ad format. a half banner is 234x60 not 234x55. That is adapting to his site not to make it look huge, and it cuts off part of the Ads by Google off.

A premium publisher can use ads on any site just like a regular publisher. Also Alexa is not a trustful tool, as it only measure webmaster's traffic that use its toolbar and quite poorly on some sites.

That is true, if premium publishers have the same rules as regular publishers. As I believe we all know by now from examples we see all the time, premium publishers do not have the same rules. The only way we can find out what are the exact rules for a premium publisher is if:

    A) We become one ourselves or
    B) A premium publisher decides to let us all know

I doubt b would happen anytime soon...

still pretty bad, if you click on the blue arrow to download now you end up in a MFA site with the arrow on top of the page of ads ... sigh premium publisher ... greedy bastard.
