I know a member here has been a scam artist. He has been banned from 5 forums that I recall due to defrauding his customers and employees. He has threatened my legal division of my host that he will sue us if we "help with his downfall" Would it be right to post our evidence here. He keeps claming "were bias against him since we are another host". I see that person has a better trader rep here then me but I have no reason to lie. What should I do?
At the end of the day it depends if you feel the risk of being sued is out weighed by what you will gain by telling the wider world... even if there isnt a case to answer someone can still take your time/ effort by issuing
Obviously, if you have evidence against him, he's not gonna be able to sue you with a legit reason. Yes, he could take up your time.. Maybe find a way to post it anonymously? Or just talk with a lawyer and get all the facts straight. Present it all legally then..
Defamation requires a false statement from you. Make your statements factual or clearly opinion. http://en.wikipedia.org/wiki/Defamation You can read more on the wiki. Normally when someone threatens defamation it's a last ditch effort to shut you up. Personally I would take it as a compliment that you are effecting their scamming.
This is right on target. 9 out of 10 times this is usually the scare tactic of scammers. However, you should be sure that your statement is clearly not false and accurate as written.
