Our website Clanwars.cc is being DDOS Attacked at this momment due to an issue with a user.

We need to seek legal help, yet no one is co-operating. We contacted AT&T and other companies related, and no one is really doing anything.

    We need suggestions, and quick.

How to we catch this guy, and how do we seek legal action against him?

The best thing to do is contact your data center hosting the box.

The chance of them being able to hold your site down for exceptionally long periods of time is very slim. When it goes back up, contact the user.

Don't threaten him with lawsuits or the such, its very hard to track people down. Just wait until he calms down and acts mature enough to stop doing dumb things like that.

Well the server is actually our own, so any chances of tracking him down would be on our own means.

That's what lawyers are for. But don't expect a lot since much work is needed
to possibly achieve the desired effect, namely catching the party responsible
    for that.

In the meantime, your short-term solution is to work with your provider to be
able to somehow mitigate the DDOS attack, or move to one who can take the
    brunt but costs extra.
