What kind of issues would I have to worry about if I was going to create a private torrent site like Demonoid or Oink? I am located in the US, would it have to take place over seas?

theres always the issue of the MPAA suing you in one way or the other..i ve know some Forums..warez based for movies also..that got sued..this is different i agree..nonetheless there are movies and all...so i dont see why not Sweden is your best choice or offshore hosting on countries like malaysia and Hong Kong etc..
If you are a citizen of the US (and not simply located here) hosting an illegal site offshore is not enough to grant you immunity. In fact, doing so has in some cases brought additional charges (not in any torrent cases that I know of though). The concept is that by hosting elsewhere you would be aware of the legal ramifications and were trying to avoid them. While you may not be breaking the law in the hosting company, you would still be a US resident and are expected to follow US law. There are ways to insulate yourself but they are generally complicated. They involve not just hosting the site offshore, but setting up a company offshore. In some cases the company must be at least partially owned by foreign interests (it depends on the business itself and I am not sure where a torrent site would fall under this).
