If it comes to our attention by the rightful owner of the copyrighted material that you are infringing, we reserve the right to terminate your account.

This contradicts what Troy said on the previous page. He said

    This

You guys need to be consistent on your rules, Now, can you pls. explain it once again.

If the owner of the copyrighted material file a complaint on you guys, will you terminate the account right away or you will just delete the widget on the website where the copyrighted materials are located?

If a account has been terminated, will you still the remaining income of the banned account?

    Which is which?

    I'm confused.

And what if it doesn't come to your attention by the rightful owner? But instead you see a site that has movie links. Can you still shut it down? Or do you have to wait to receive the attention of the rightful owner of the copyrighted material that the person is infringing??

We reserve the right to cancel your account, however for most instances, we will ask the copyright violator to stop. You assume all liability for your content, and if original owner of the copyrighted material wants to take action against you, they can. For your own sake, I suggest monetizing content that you only have rights to if you want to avoid these types of problems. Please refer to our ToS if you have anymore questions regarding our policy.

    A change of tune...

So if an account had been banned, what happened to his/her remaining income?

In cases where there is no fraud, we will pay the full earnings unless ordered not to do so by court order or written request / dispute from the copyright holder.

Why do you suggest on your website that your publishers should use movies and tv shows to monetize?
This is what CPAlead.com states when i want to create a video widget " Monetization Suggestions: TV Shows, Movies, Tutorials"
I can't find a tv show or movie that is not copyrighted.

Are you only banning publishers that HOST copyrighted material or people that LINK to copyrighted material or both?

Also i find it really hard to believe that the copyright owner would contact CPAlead and NOT the owner of the website that links to or host the copyrighted material.

It seems like a firm was hired to shut down all of these tv sites. I'd bet that cpalead is being forced into cooperating with them to avoid a lawsuit.

I just got my Application denied for "Questionable content" :(

But I made a big mistake in using one of my more "adult" sounding domain names. No adult content, but did have an adult domain name and used it forgetting it was against their ToS.

Is there anyone out there that can actually help me setting up a new website & getting traffic?

-I had set up a movie site, but i dont want any legal troubles
-I've been scammed out of $200 on buying services and tutorials...which did not have any effect.

    Please someone?

How can we(publishers) really know that there's an actual complaint about our websites? Will you guys also send us the letter/e-mail? Or send as the written letter via request?

Again like what I said on the previous page, it seemed like you guys are violating your own rules by auto-approving websites with copyrighted content and if a publishers get a complaint from the copyrighted owner, you guys will put all the blame to the publisher and will ban him right away and most probably will not get his hard earned money in CPAlead.

C'mon let's be real here, 90% of your publishers are using copyrighted content(80% are not aware of this TOS) and they are now in danger of getting ban. If there's something happening inside of your company, typing an e-mail to your publishers regarding this issue would be very helpful for us, C'mon it's just one click of a mouse. You guys needs to address this issue seriously to your publishers because it may backfire on you guys big time.

Again I will not change my view regarding this unless you guys do something to protect your publishers about this issue.

For those who don't know what is going on:

    http://news.cnet.com/8301-31001_3-20005810-261.html

They are after all mayor websites and dedicated to clean all. Considering cpalead is one of the biggest money makers in this field, no wander they are taking action against them and their publishers.

Bad news, but it is game over boys.

I still think cpalead should pay remaining money to all or send a proof otherwise was demanded by copyright lawyers.

That image above is from the widget tab on cpanel page of every publishers. CPAlead is suggesting publishers to monetize their website using movies and TV shows. Then we have here users who are complaining that their accounts are banned because of a copyrighted content on their websites.

This is really confusing. CPAlead is pushing their publishers to use copyrighted content w/out them giving a warning that their accounts may get banned if they do that.

There's conflict of interest there. CPAlead employees don't get me wrong here, I love CPAlead and it's a great way to earn income from the internet but as a publishers I feel like our hard earned money will be put into waste because of this issue. That is unfair to us publishers and that's what I am seeing it from my own POV.

I expect CPAlead employees to remove that little box suggestion because of this issue and hopefully give us assurance that our hard earned money is secured no matter what happened.

    Guys,

Just because we have a widget to monetize movies, TV shows, and other video does not mean we are promoting the use of existing copyrighted material. There are plenty of publishers who own the rights to their own video content.

There is clearly a safe harbor provision in the DMCA that states we are legally liable to adhere to any copyright infringement requests. We have always had that stance.

So let me make this perfectly crystal clear. If the legitimate holder of a copyright contacts us to notify us that one of our publishers is violating their Intellectual Property rights, we will immediately suspend the account and notify the publisher. We will then ask that publisher to sign a form, stating they will no longer infringe on the IP rights of the complaining copyright holder. If the publisher signs this form, we will pay them the money earned on their account, and they will be allowed to start a new account with us.

This is not some way for us to keep our publishers' money. This is us following the law, which all affiliate marketing networks adhere to. This is not an issue unless you are making it one. The more noise you want to make about this publicly, the worse you make it for your fellow publishers. We obviously have no way to know who owns what content upfront. It would be rather arduous for us to check the copyrights on every single publisher we have, every single time they change their content, on every single website and webpage they own. We now have 76,000+ publisher accounts.

If you are currently making all of your money by using copyright infringing material, I highly suggest you decide to diversify your revenue streams. You should never have all of your eggs in one basket, especially when the basket is not owned by you. Diversify into other markets. There is plenty of content to monetize on the web.

This video you are seeing is our Referral Video. It will show to countries with low converting offers that are performing poorly. The video basically informs the user about CPAlead, and if they have a website of their own to monetize they may sign up under you as a referral. You will get 5% of their earnings if they end up promoting our offers, so this can sometimes generate more revenue compared to some low converting offers that might be in our system for certain countries.

This feature is completely optional. You can toggle the video for each country from the Surveys & Referral Video tab on the Widgets page, after you click on your Widget of choice. Just use the drop down menu and select a Survey amount rather than the Referral video.

If you have any other questions about this feature please ask. You can reply here or contact me directly at
