I own http://tiptopdirectory.com . I am not affiliated with tiptopdir.com, which seems to share my name. I am thinking I am OK since my site is primarily free and the other one is pay only. Do you think I may/could get sued over this? I just googled myself and this came up too... Arrgh!
You really should have checked this before starting your project. I think it is very unlikely you will be sued, but it's always best to be unique when possible. Good luck.

Well, they claim to be Tiptop Dir in their header image, I am Tip Top Directory. I am quite a bit different...I am also a freebie directory, etc. While he uses Tip Top Directory for the text title, I hope that no bad things can come of this...
I'm new into this, but I dont think it'll be a problem... I see many typos which have opposite things.. And its not your fault that your directory is similar to that other.. At least you dont differ by a tld like .com or .net its completely different..
I was going to put a "not associated with tiptopdir.com" But I will leave it alone, and hope he doesn't notice when my site somehow overtakes his in google in a few months.
