I would like to know how can Copyrighted images be diffrentiated from non- copyright images .. Suppose someone reports me to Google for putting a copyrighted image on my image , how will he proove he is owner of that image and it is copyrighted ?

    thx

simple - assume that any image you come across *is* copyrighted, unless you see notice explicitly posted stating that the image is either not under copyright, or has a posted list of conditions under which the image may be used.

So this is a big risk to Myspace resource sites which have lots of images?

Huge. Of course, I believe that after acertain number of years, images become 'public' domain. Plus, the vast majority of image infringements are not necessarily pursued legally. In fact, most people don't care, at all - I know that there are images out there which I legally have to copyright to, which I have seen around the net, but I don't really care. I am sure many copyright holders feel the same.

But, for safety's sake? I make sure I know the copyright data on images I use in my sites. Often, I just take them myself to save the hassle.

All he needs to do is provide the original with reasonable evidence that it belongs to him. In fairness, there isn't much he can do, unless he registered his Copyright.

Of course, let's say the original was taken by a sports photographer somewhere. He could potentially have copyrighted every image on his real. Let's say that the image get's grabbed, cropped, and passed along through a few people before it gets to you. You are still screwed. In fact, if it looks like the image was taken professionally, there is a good chance that they have the originals/negatives etc. stored somewhere against cases like this.

either way - if the original author, for example, has a copy of the original with a confirming timestamp on it, stored on a CD or other unalterable media, he could still sue your ass...

to make along thread short, use your discretion ;)
