I'm looking for some advise. I'm currently in the middle of doing a new site. And a competitors website has a good TOS (Terms Of Service). They also have a copyright notice on there text which i guess covers there TOS content which i want to use. My question is how much do you have to change before or how different does it have to be without being libal for copyright if at all? Also what protection can i take to cover my content. Thanks
First try asking them permission for use of those contents. If they deny you must rewrite the whole thing.
It would be better if you wrote it in your own words but same points, just scramble them in a different order that way it's not as noticable. I would say 70-85% must be different to help clear you of copyright infringement. Just like when people blur out logos of companies in movies that wish not to show up.
Technically all of it. Practically, a lot of sites have the same language. Look at a few and compare them and take a little of each. Want to protect yourself for a real venture? Hire an attorney. They know provisions you'll need and different sites need different things.
Yes, rewrite it with your own words. Shouldn't be that hard, and maybe you could write it so that anyone can understand it, not stupid legalese which gives you a headache...
