Copyright Violation?

    If I create a script based on a tutorial I find online, is it legal to sell as my own?

    1. The script would not be the same as the tutorial's version...
    2. The tutorial had no notice of authorship or copyright...
    3. The site it was published on didn't have a TOS page...
    4. The site it was published on didn't even have a copyright notice...

    I understand that notice isn't required for legal coverage, however since this is a tutorial, I'm not sure.

    Anyone know?

    The only sure way to know is to contact the tutorial author and ask. Anything else is just hearsay.

    Well, just a specific aspect is from the tutorial. more than 90% of the code will be custom, and mostly unrelated from the tutorial.

    #'s 2-3-4 don't matter - they aren't needed for protection of intellectual property.

    #1 is the key - there is no percentage of change to get around copyright infringement, but on the other hand, the you can't write a tutorial on how to do something basic (like crop a picture) and then claim ownership of the concept.

    It would be best if your script could accomplish the same thing using a different approach, but even an attorney couldn't give you an opinion without knowing exactly what it is you are trying to do and also reviewing the tutorial in question.
