Copyright Violation and server responce

    Hello,

    A forum copies everything from a small publisher. Actually the forum owner has 2 different in two different servers and he copies to both.

    DMCA procedures with the two servers bring contrasting styles. One server has taken a soft approach, by, writing to the forum when publisher complains. The content is removed.

    The other server is asking legal procedures from the small publisher and tells inability to bring the forum owner to books.

    severs have their own policy of disabling the websites in case of multiple violations.

    The small publisher cannot afford attorney fees and is located in another country.

    What do you suggest in such a situation?

    Well internet has brought a lot of benefits, and at the same time many problems regarding intellectual property rights which by the way will be very difficult to enforce if you've got no or little budget and are located in a different country.

    At this point the publisher can only keep on writing to the server admins in the hope that they will soften up and will remove that content from that forum, otherwise in reality i don't see it happening too soon.

    Thank you for the quick reply. What does it cost to hire an attorney in US for copyrights? Will a case in other country used by server or google adsense to disable the offending content?

    What is the server responsibility towards DMCA? Can we complain against the server with this regard?

    You can find lawyers who deal in copyright issues by searching on Google, and then contact their office by phone, and they'll let you know their fees after first listening to the whole issue. But don't expect the fee to be low.

    If you file the case in that country where server is located your lawyer can ask the court to order the company to either suspend or remove the content temporarily until pending decision of the court or in some cases the court can order the company to remove the copyright content permanently after a first or 2nd court hearing of the case.
