Copyright Removed And Re Selling Content

    Hi friends I am new in this business industry, can some one tell me what action is to be taken, if I own a script and:

    1. Some one remove the copyrights without my permission.

    2. Some try to resale script when he don't have the rights to resale.

    Hope you understand what I mean...!

    Just send a warning to the person who has copied your contents, eventhough u have protected them. By the way, u should have a legal disclaimer put up on your website , so that nobody steals the content.

    If he continues selling my product after the warning too, or if he donn't insert the copyrights after my warning, what can be done in that case, what action is to be taken?

    The best solution is to contact his hosting company for suspending his account. You can find this by simply looking at the whois output. Send all details to prove that you are the owner of that script and he is illegally using that.

    Or if you can find his address, hire a lawyer to send a Ceast and Desist letter to him.

    Did you create the script for that person? If you did, and you did not get in writing that you retain the copyright, and that person does not have resale rights, then you do not have a legal leg to stand on. As work for hire, the copyright and all rights associated with it would transfer to him upon full payment.

    If you coded the script by yourself, and just sell it, or give it away for free, it would all depend on the license you sell it under. But generally, unless you specify it in the license, it would be illegal for him to resell the work without giving you royalties. However, (not 100% sure about this) I believe him removing the copyright is ok. Remember, not 100% sure about it. Unless, of course, your license says otherwise.

    If he continues doing this stuff after your warnings, you can go to his host, and if that doesn't work (after you have provided all information proving your the copyright owner) then you can not only sue him, but also the host.
