Copyright Question ???

    Hi

    I have a found a very well written article that is ideal for one of my websites. Is there any way I could use it? If I put down refrences would that help?

    Or should I rather write my own article on this topic?

    Writing your own articles is the best method since you "own" that article.

    If you intend to use another article from another site, check with the owner. Send the owner an email to request for permission to re-publish.

    I would recommend writing your own as it would benifit not only the readers, getting some exclusive or rather a more different approach to the issue but it will also help out with the search engines getting fresh content rather then a duplicate.

    Sorry just a update:

    The article I found is in a old magazine 1995 edition. I have searched for the same keyword phrase on the net but couldn't found anything similiar.

    Would it be legal to give an refrence to this magazine??

    Under stringent copyright laws in North America, it is unlikely you have the right to use the article without written permission from the magazine publisher and/or article author. However, the "fair use" principle allows you limited rights to quote several direct passages from any source (books, magazines, newspapers, etc) with appropriate references to the author and publication. That's how book reviewers are legally able to quote passages from the books they are reviewing; they are not allowed to reprint the entire book under the 'guise' of a review.

    So your best course of action is writing an original article on the topic, with occasional direct quotes from the magazine article you found to shore up or illustrate your viewpoints.

    That will give you the best of both worlds ... original content with authoritative quotes from an expert.

    Debare is right. You could be guilty of copyright theft if you just reproduce someone else's work without permission. Copyright will belong to the magazine, or to the writer, depending on which rights they sold. It's not fair to just take a writer's work and reproduce it: we'd all go out of business if anyone could do that :)

    Putting references or citation alone is not sufficient to protect you from copying others's articles and pasting in ur website, You need to take prior written permission from the author, owner, publisher, editior whomsoever the right is vested upon.
