What a great post for future legal issues concerning celebrity websites. Most celebrity website are illegal and they are getting shut down. Even AVS adult verification services stopped servicing many thousands for copyright infringements.

But most fan sites are harmless, but still greed takes over. But if you are a non for profit organization you can use any copyrighted photo most of the times from the official sites that have them.

If you do run a celebrity website it needs to be in the format “E-News” Celeb News” “Movie Reviews” or a tabloid format. Instead of these mass picture archives and text you do not need any consent. You are also allowed to use picture without consent, if you include some biographical information about the picture and use it as a “Review” type system. Of course give the orignal owner all the credit and where you took the picture from.

    For example

For example, one Adult site features movie stills along with biographical information on the actresses and ratings of the sex scenes in which they appear. "It's considered educational and newsworthy site, therefore he (the webmaster) doesn't have to have consent. It's like a news show showing a clip from the new Star Wars movie," said Greg Geelan, an attorney and president of YNOTmasters.com, which provides support to the webmasters of adult sites. This also can be implemented with non-adult celebrity websites and fan sites.

You are not legally responsible for a link in which you link that may be Illegal. You wonder why search engines do not get in trouble for linking to bad things? This is why… It’s Law…

I hope this helps a bit and gives you an idea what direction to go.
