Copyright Issue - Photos to Vector

I was hoping someone might know the answer to this.

If I were to take a photograph, any photograph, and using photoshop, create a vector image based on that photograph, would it be a violation of the copyright for that photograph?

Keep in mind, I don't mean using a simple photoshop filter. I'm talking about actually redrawing the vector artwork using the photo as a reference.

For example, take the following photo and resulting vector drawing. If I were the one who created this and used the image in my projects, could this lady sue me for the resulting vector image based on the photograph:

Wrong section bud.. It should go to the legal section of the forum.. This section is for copywriting and not copyright. Lol. Report the thread to a mod if you don't want an infraction.

And to answer your query, well, it depends on the nature, but generally speaking it sure is a violation because you are still using the source image as your framework.

    Godspeed!

See "derivative work" under the US Copyright Act.
