I want to copy an idea of a flash game. The flash game is developed by a design company. I want to copy the idea of the game, recreate it myself and sell it. Basically the game will be identical except I'll give it a new name, new graphics and new sounds. Can the company sue me? How different do I have to make it in order not to get sued?
As long as you code it yourself, and that coding is different, you should be fine. Keep in mind however that names could be trademarked, and there are a whole host of similar issues to consider. It is always best to consult an attorney, of course. Also, keep in mind that re-creating the game may well be seen by (potential) users as unimaginative - hence not worthwhile. The idea itself can't be copyrighted, though, depending on the idea, it could be trademarked in various ways, especially relating to names. Also, the execution of the idea leads to rights - images are definitely copyrighted as is code once it is published. So, really, be cautious.
I agreed, as long as you recreate the code yourself. But if what you do is a MOD you need to check with the company terms.
