Competitor using our trading name

    A company has produced a cheap copy of something we sell, and is using *our trading name* as a keyword in adwords to serve up their sponsored ad. Is this legal? Anything we can do?

    It really depends on how strong your trading name is. For example, some highly protected brands have successfully prevented their brand names being used in the ad, although the ads can still be triggered by the name, the important thing was to prevent the name being used in the ad itself. You may want to get in touch with the ad provider (Google?) with a view towards preventing the trading name being used in the ads themselves. There are no guarantees but it's worth a shot.
