Competitor Tactics

    A company that is competing with us seems to be contacting every vendor we do business with and giving false statements that we are illegally using content or images without the vendors permission and even some articles. This is totally false .
    Basically, I want to know what you would do ?

    I don't want them to contact our host and the host neglects to contact us and our site is shut down based on false accusations of copyright infringement.

    We have long standing affiliate agreements with numerous vendors from cj, linkshare, etc. to advertise and sell their products. It is similar to an authorized reseller selling compaq or hp stuff. Some of the product pages have minimal descriptions and a link to vendors. This is common and accepted practice with many competitors.
    AND they have seen some landing pages.

    I don't want the competitor sending ridiculous cease and desist emails to google, yahoo, and others which could get us banned, thus dropping our PR and serps. They may even contact our 1-way links.
    This is crazy and uncalled for and should not be allowed. We have already received several emails from counsel of various vendors we already do business with to stop advertising.

    any advice... or do I just get an internet attorney..? any referrals.

    I would contact your host just to let them know before they get email or letter. I would ask a lawyer about the rest.

    If you're serious about it, and you're really not doing anything wrong, then sue them for libel / slander (libel's probably more appropriate in this case).

    If you know who it is, do not accuse them, it might backfire on you.

    Consult a Laywer who is a wizard with internet related cases. They do exist.

    Don't try fixing this yourself, you could make the matter worse and get your fingers burned.

    An IP lawyer is your best bet. People specialize in this for a reason. They can take the appropriate action.

    I agree that you should make 100 percent positive of what they are doing before moving forward. Although you probably know what is going on, making a false accusation is never a good thing...
