Company name for freelance business, help needed!

    Hi guys,

    I wish to do freelancing on websites such as iFreelance, Elance, etc. But the problem is I do not want to use my personal name. I want to use a created name such as company name. But if I select a name, say WebMedia or GraphicMultimedia, will I have to register it as a business necessarily? I want to select an appropriate name as I will need to present it in my pdf portfolio, website, etc. I cannot have portfolio without name.

    If I register a domain against the name but do not register the company, is it legally wrong? What should I do? What would be the best solution for a graphic designer who wants to do freelance work and wants to have a website to present information and portfolio?

    There are tons of people just like yourself that are running under a assumed name. A lot of states simply require a DBA to be filed at the local county court house. You can call your county's government office or your local chamber of commerce to get additional information. Hope this helps.

    Depends where in the world you are but your personal name will almost certainly be available as people have a legal right to know who they are trading with.

    In most countries you would have to register a trading name or company and if you do then this becomes a public record. OK, so you don't have to put your name on the website but if someone checked (eg in the UK with Companies House) they would get all your personal details.

    Remember that the internet is increasingly about trust, shadow organisations which use layers of complexity to mask themselves will struggle to be trusted and will struggle to get established.

    Why do you need to hide yourself? Surely an "about us" saying you've worked in the industry for years, knew the problems with the other sites etc and now want to set up a service for service providers by a service provider will do you much more good? Or should I assume you are going to be in breach of either a employement or benefits contract and so don;t want an employer or state to know what your doing?

    Assuming you're in the United States, visit your local County Recorder's Office. You file a "Fictitious Business Name" application, which gives you a DBA. You'll receive a certificate for this. Then you have to have your new business name announced in a newspaper. You just visit your local newspaper, and they always have someone who specializes in public notices. They will ask to see the certificate. After that, you go to your bank, and set up a business account under your DBA. They too will ask you for the certificate. Now you can accept checks with your business name. This makes you a "Sole Proprietor" in the eyes of the IRS.

    In some cases, you may have to obtain a business license, usually if you're operating a business where customers visit you in person. If you're just doing affiliate marketing and website publishing, where your customers only contact you via e-mail or phone, you don't really need a license.

    When you say "register the company", what you are doing is simply associating a new business name with yourself. As far as the State, and Federal government goes, there is no company, only you. If anything, a business license and store front might establish a company, but still it's only you in legal terms.

    So to answer your other question about registering a domain name without registering a company, this isn't really an issue. It's only an issue if your business name has already been trademarked by someone else. And trademarking is another totally separate issue.
