Thanks for making it clear you have no actual trademark experience (it did show). The link you gave was denied on the basis of being descriptive - and if you would have comprehended my earlier post, I already stated that "Generic/descriptive terms for their normal usage are not eligible for trademark protection unless the term has acquired secondary meaning." which is the same reason your stupid idea of trademark "donut" and going after "donut shops" wouldn't work. You could get a trademark for "donut" in certain classifications (which has already been done): Word Mark DONUT Goods and Services IC 035. US 100 101 102. G & S: Advertising services for others via the Internet; creating indexes of information, Websites and other Information sources, all containing information concerning marketing, law, information technology, sates, purchasing, premises, human resources, funding, finance, tax, accounting, business planning and all and any other topics of interest to micro, start-up, small and medium-sized businesses; maintaining, indexing and electronically distributing advertising materials; compiling, storing, analyzing and retrieving data and information, namely, information concerning marketing, law, information technology, sales, purchasing, premises, human resources, funding, finance, tax, accounting, business planning and all and any other topics of Interest to micro, start-up, small and medium-sized businesses; business advice and information, namely, providing and facilitating the sharing of business information and professional business information intended to enhance opportunities for business and professional advancement; business advice and information, namely, providing and facilitating the sharing of business information and professional business information offering opportunities for businesses and others through the medium of an Internet Website; compilation, provision and updating of a business database for the use of subscribers, namely, providing an on-line computer database featuring trade information In the field of marketing, law, information technology, sales, purchasing, premises, human resources, funding, finance, tax, accounting, business planning and all and any other topics of interest to micro, start-up, small and medium-sized businesses IC 041. US 100 101 107. G & S: Electronic publishing services, namely, the publication of electronic books, magazines, journals, and online information concerning marketing, Law, information technology, sales, purchasing, premises, human resources, funding, finance, tax, accounting, business planning and all and any other topics of interest to micro, start-up, small and medium-sized businesses; the provision of non-downloadable material on the Internet, namely, information concerning marketing, Law, information technology, sales, purchasing, premises, human resources, funding, finance, tax, accounting, business planning and all and any other topics of Interest to micro, start-up, small and medium-sized businesses; advisory, Information and consultancy services relating to the aforesaid, namely, the provision of such services online from a computer database or via the Internet IC 042. US 100 101. G & S: Web site design, creation and hosting services; computer services, namely, creating searchable indexes of information Web sites and other information sources available on computer networks; providing temporary use of a non- downloadable computer software in order to provide information concerning marketing, Law, Information technology, sates, premises, human resources, funding and alt and any other topics of interest to micro, start-up, small and medium-sized businesses; computer services, namely, acting as an application service provider In the field of knowledge management to host computer application software for providing search, retrieval, indexing, linking and data organization capabilities for the internet, electronic communications networks and electronic databases; research, development, design and upgrading of computer software; computer programming; computer network services, namely, computer network design for others, computer systems analysis; information, advice and consultancy services relating to all the aforesaid Now until you grasp the concept of usage and classifications, I would advise that you do not make any more posts on trademarks - which again, you agree you have no knowledge of. People who are asking legal question do not want uninformed guess from novices with no legal knowledge. Thanks.
LMAO Are you serious right now, each new post you make disproves a previous one you made prior to it.. 1st post: "If you use money.co for a finance related website, you are at risk for being sued for infringement and paying the treble legal fees of the mark holder, plus damages" 2nd post: "Generic/descriptive terms for their normal usage are not eligible for trademark protection unless the term has acquired secondary meaning." Do you see the conflict there? Your legitimacy is going down the drain, and I am going to have to start charging you by the hour to keep correcting your logic. Oh the irony....
So when you hear the word "money", you would define it as "Downloadable multimedia file containing text, audio and video relating to business and finance; Video recordings featuring business and finance." -- LMAO. The trademark was already granted, period. Your LACK of comprehension is amazing. Thank goodness you never went into law.
"The trademark was already granted, period." LMAO you really think so huh? The only "period" is after they decide to dish out the cash, take it court, and the judge decides on it. Yes, my lack of comprehension has a difficult time understanding your two contradictions opinions on "general term trademarking". In-light of the class Time.inc trademarked the term "money" for, there is no problem in owning a money.co, as long as it steers away of their class. And if your rebuttal is to say that any domain-name/website would be a confliction to "Downloadable multimedia file containing text, audio and video relating to business and finance; Video recordings featuring business and finance", then that becomes unlawful, as my donut example (which I hope is simple enough for you to understand) proves, that trademarking "donut" and prohibiting any shop with "donut" in the name is unlawful and that "domain-names/e-shops" are relative to a "shop"; thus prohibiting a website with the term "money" is impossible to enforce. (It is fillable and they can take you to court, as anybody can for anything, but impossible to enforce in the end) In the end, you have failed to prove your fallacy of "why that term cannot be used for another domain website". And as hilarious as this is, very little knowledge on the subject is needed to disprove your thinking. Like I said....maybe in 15 more years....
Read my first post on this thread and realize how stupid you are. Thanks. BTW, Your first post on this thread "No, money is a general word, and cannot be trademarked." So now that I have proven you were wrong, was your statement pure ignorance or a lie? Even though everything you have posted is wrong and utter nonsense, if you are ever taken to court in a trademark infringement case, be prepared to spend hundreds of thousands of dollars, and even if you win, you won't get that money back. The financial costs alone would make it impossible for you to even mount a defense.
I recommend you do not risk with those domain names. Because one day you may lose all of the domain names.
