Well he seems to be legit and just hadn't been online in a week due to his personal reasons but he will contact me this weekend and send the rest of the money so hopefully ill have it then, that's why I wanted to hold off on the DMCA letter and not jump to conclusions, but thanks anyway for the help. Also not sure how I'd only show half the design lol, not sure the client would want to send everything from seeing an incomplete design

i dont think he was making any problems here, this person has done the work, that someone asked them to do, and they did that in good faith, only taking 40% up front. i sympathise with the loss of the other persons relative, but he could easily have asked some other relative or friend, to contact shawon, and explain the situation. how would anyone here have felt, if they had paid 100% money upfront for the site, and shawon, was not at the computer for a week, with no contact as to why the site has not been finished. just asking other members for advice, and that was all it was, was just a precautionary measure, that im sure anyone else put into this position, and unsure what to do, would have done.

Perhaps you can work out a payment plan if he doesn't have the money.

From reading this thread it's so obvious people just read the first post before replying,

You have to be careful with this kind of stuff because what happened to me once is I gave the person whatever I finished for him (not everything) and I said that it is too much for me. Than after 2 weeks I see that he takes is down payment he gave me $100 by opening a dispute to paypal. I showed proof and all that to Paypal, I talked to them on the phone 3 times and they said that they cant do anything as it was not a real object that took place in the business.

You have to be careful with this. Especially when selling graphics, doing graphic projects etc.

If you have a good family lawyer, just talk to him about your issue.

They usally give like a free assessment and help with making a case ect..

You have to let the client know you are reporting him for copyright.

Try using trackers on your emails so you can see if he is away or just ignoreing you.
Therefore you will have proof he is reading your mails.

    Good Luck

Glad that it is sorted out. It just seemed funny that someone would go to the trouble to copy and paste the code and take the images from your portfolio. When they could have just paid and received the site.
