Hi, I live in the UK, and set up an account with Commission Junction.com, I would like to start trading but I need to verify my tax information before I can withdraw payments. My website is hosted in America, and I have no employees or equipment in the US. Would I be correct in filling out the Certification Of No United States Activities - under non us persons? IMO, yes. But I am not a lawyer or accountant. I am fairly sure that starting in 2010 you will have to dance through a few more hoops. I don't recall what form it is that the rest of the world has to file to keep the IRS vultures happy.
I live in Canada with most of my websites are hosted on USA servers. I fill out the Certification Of No United States Activities many months ago and haven't got any problem getting my checks since. If you don't have any employee in US, that's the one for you. You can even have US customers only, as long as you're not physically based in the US. Yes, I remember asking myself about the servers being in US, this part is quite confusing. But after reading all the small prints I'd understand that having servers doesn't have anything to do with having equipment in the US. We are only leasing them, after all. And it is not like having an "office". Well, who knows, I may be wrong. I would like to know...
peterzeller is correct. If you don't own, lease or rent full servers, do not have an office, do not have employees, and do not portray yourself as being a United States company, then you can simply select Certification of No United States Activities and you'll be fine. Simply paying for hosting space on a server or with a hosting company in the US does not apply. However, leasing an entire dedicated server for your site is a sign of US Activities.
Yea u just have to choose the no us activites form coz buying hosting i dont think counts ask a US Activity
Hi all, Regardless of where your from...you still have to claim these earnings on your income tax, correct? For eg, for the people in Canada, are you claiming your earnings during tax season next month? If you make a few hundred a year it's nothing, but if your making thousands a year, I believe you may have to claim... I'm trying to remember which form I filed out as well, I believe it was the W-8BEN and didn't check anything in section 2.
