Cease and desist letter from Microsoft

    Hiya,

    I received a letter from Microsoft recently asking me to "hand over" my domain www.instantxboxlive.com what should I do?

    I've changed the domain to www.instantlivecodes.com, but my question is ccan they simply "take it"?

    Yes they can, they own the xbox trademark so what you are doing is trademark infringement.

    Dude, I advise you give them the domain, and stop selling Xbox Live things, unless you are an authorized dealer through Microsoft. Your going to end up in a world of trouble. Around Jan 27th Microsoft filed lawsuits against about 25 different people for trademark infringement. If they sue you, you will probably lose any profits you have gotten, and any potential profits they MAY have lost.

    And hope they don't ask to review your entire portfolio (They want to see if you are a black hat cybersquatter) and ask you to pay damages. This is their new policy. If you are, they will sue you and demand payment of money. We have several matters going with them right now. They are getting very aggressive in their enforecement.

    I have bad news for you. Your domain name is the least of your problems. You really should stop selling XBox Live codes if you are not licensed to do so by Microsoft.
