How can you "get one of those themes" for $40?

Rightly said, No one can/should sell them in "Second hand" without permission of Brian. You cant get any "Support" for that theme if you purchase like this.

 

Are you looking for negative rep? I'd highly suggest you not sell my theme, or I will disable it's use for you and the person you got it from. This is against the terms of service and I will be more than happy to pursue legal action with you if I find out you and this person are selling my themes.

You may not resell this theme in any way, shape or form. The Revolution themes are designed to be used once for those who purchase the Single-Use Package and for multiple use on sites for those who purchase the Multiple-Use Package. You may use the themes as a base to create sites that you develop for your clients, but selling the themes outright is prohibited.

Actually, you did try to sell his theme (via PM). Or at the least, alluded to putting them in contact with a person who would sell it for an amount half the price of the original.
