Can We Use Similar Privacy Policy & Terms of Use Pages With Googles Panda Update!

    Can we use similar Privacy Policy & Terms of Use pages that are
    popular & only change a few text words like our domain name
    that won't pass copyscape with the new Google panda updates.

    from my prospective it's better not to use the exact same one or the one which certainly will not pass copyscape. If u wanna make it same I would suggest you to just rewrite it keeping the theme intact. Because what I guess is Google bots can't read your content but the certainly can identify the copied content and they discourage to do so.

    Usually the Tos are mostly the same on all sites. Also you can make the links to the page not to be indexed by search engines. In this case you won't have a problem that you copy most of the TOS.
