Can this really be copyrighted?

    On this website, you will see there is a special "popup" which appears asking you to vote. This uses something called modalbox, which is free to use by anyone.

    This is the code used which makes that popup:

    Now when I replaced some of the URL information and added this to my website, the guy said it was copyrighted and I couldn't use it. Is this true? I totally respect it if it is, but the guy might just be lying so I wouldnt use it. Thanks

    Ok, are you sure about that? Because the guy told me he had several coders making this code and it was copyrighted. He said if I didn't remove it he would deal with the legal matters so I really need to be 100% sure.

    Yes, code can be copyrighted. If they made it, they can say who can and cannot use it.

    Ok, so in this particular case this could be copyrighted then? Im no html expert so Im not sure how easy the code could be to make. I mean, if I wrote out <img src="www.google.com/image.jpg"> I can hardly copyright that. What about if the code were altered?

    Depending on your country, copyright is a very light accusation as it is so widely used and said by everyone, don't get me wrong it is nothing to avoid or put down but you have to respect the owner, however if the code is branded on the Internet as free by this company you say then it is up to them, not the individual you are dealing with.

    Use the code and say look this is free to get from the Internet it is not yours to copyright and end the conversation there no matter what, if for some reason he has copyrighted it, wait for him to contact you with a letter from his lawyer etc, 80% of the time the person won't get legal proceedings involved as it costs money and time consuming (if you don't get a letter etc then you will know he was bull$h!tt!n6 you).

    If you do get a letter, not an email, make sure you respond saying due to my own security and discretion please contact me via post, chase its authenticity, see if its real or fake.

    If you believe it is real all they will ask and can ask is that you remove it from your site, all you say: Sorry I believed it was free to use from this source here: link it. However I will remove it to comply with your demands. End of, happy ending and you contact a coder to create something similar!

    If it is fake and you cannot contact the lawyers office or find trace of them then you could well disregard it and continue until you get another letter, if real at all.

    That's pretty much all they can do, first they have to get your address! If a lawyer wants to contact you they will, do not give out your address to any old person. Lawyers have legal proceedings in which to contact you.

    For example if you were to receive a letter, write back and ask them to confirm their registered company number, head office, head office number, client they are talking about. Make sure they are real and genuine! If they are real and he has spent money going through a lawyer to contact you by hell remove it fast lol!

    Please be aware that this comment is my personal opinion and your choices are down to you. I will not be held responsible for your actions!

    Good luck with it but remember when a lawyer contacts you they will not be able to sling you in jail or take you to court, first you must comply to remove it, if at that stage you do not, then they will escalate the matter.

    To have a work protected by copyright you must include visible notification to the reader that it is copywritten. You must also have a disclaimer on the site that clearly outlines the terms of use.

    The only copy right notice is the IP board one, nothing else. So I guess I can use this then? Or not..?

    The code you have shown is simply the form which is displayed in the modal popup box. To get this form to appear, you will need to call a JavaScript method on the page's onload event. Also, as you can see by the code appearing on these buttons:

    You can see that they call a method called 'Modalbox.hide()'.

    It could be the case that they have copywrited the 'Modalbox' class, including all of it's methods (such as Modalbox.show(), Modalbox.hide etc). While you could reuse the names of the class and methods, I doubt you could legally use their modal popup script if they do indeed have a copyright on it.

    There are many scripts out there which are freely available and do the same job. Maybe go look for one of those?

    The idea can't be copyrighted, just the way it's implemented. I wrote a post on copyright law, it was mainly about articles, but it may help you.

    I found something that will do the same job and is available for free for people to use, its actually a vbulletin mod, so I played it safe and used that.
