    we're discussing the CAN-SPAM act, as it affects all of email marketing, legit or not

    I beg to differ. You can make a LOT of money from spam. Eventually you tick off the wrong people, the big networks that you targeted. They have big money. They find you. Then they send you to a "pound you..." federal prison as they say in Office Space. :D You also win the prize to spend your money on lawyers and pay money pursuant to a civil suit.
