Can Private Label Nutraceuticals Remove Reviews If Their True?

    Private Label Nutraceuticals and it's founder/ceo are threatening lawsuits against Dr. Oz for exposing them on national television for having fake ingredients in their products:

    I saw this report and noticed that there are a lot of other reviews about this company online and that it looks like the company is trying to have them taken down.

    Is it possible to DMCA takedown the Dr. Oz episode? How would that work.

    One other question, if this company can't DMCA take down the video, what other legal measures could they use to de-index it from Google search results?

    personally i think Dr Oz is a complete twat, but in this case he/his company own the video, so unless the other company have a court order they can't get it taken down...

    This is not a DMCA issue, but could be a libel/slander issue if Dr. Oz is incorrect in his assertions about the business. But the company will have to take him to court and go through a very lengthy judicial process for them to win the case and get him to retract what he said. And, if what he says is true, there will be no repercussions for him. My guess is that he had his team of lawyers review the information prior to going public and will prevail in court. The company merely threatening to sue is meaningless unless they actually file in court and this could be simply an attempt to muddy the waters a bit so that they can keep customers buying their products, despite the bad publicity.
