    They can sue regardless. They can win if the new site competes with them, clearly shows intent to draw traffic, or displays porn.

    Yes they can sue you and anyone saying anything different hasn't got a clue on IP Law. Even if your in India, (or at least that's where the domain purchaser is right now) you can still be sued........... BUT. and this is a BIG BUT.

    You have to be proven to have bought and use the domain name in bad faith under international IP law. ICAAN Rules, WIPO Rules etc etc. At the moment it's in SEDO parking so its not constituting bad faith registration, the second you use it in the context of the namesake you run the risk of trading in a simularly confusing manner likely to mislead the ordinary member of the public. This btw is part of the legal premise any trademark owner needs to establish is happening for any success in a lawsuit.
