    I have tried registering some of my client's domains with that character and no registrars will allow it.

    Domain names can only contain alphanumeric characters in addition to dashes AFAIK.

    thats not illegal , but impossible as ICANN had not allowed to it
    only alphanumeric and - and _ are allowed in addition to Chinese characters

    No you can not use the character "&" in your domain,the world wide web can not read & to find an address.
