im working on my portfolio and was wondering can i use this image of a guinness without braking any copyright laws? thanks. john
You shouldn't be using other people's images in your portfolio unless you can get explicit permission to use those images. Your portfolio should reflect the actual work you'd do for a client, so just taking an image from a Guinness ad isn't right. If you want to be certain an image is OK to use, get it from someplace like iStockPhoto. You can get images for as little as $1 of glasses of stout: http://www.istockphoto.com/file_search.php?text=stout You can also go to Flickr and do an "advanced" search. Tick the box under "creative commons" that says "allow commercial use of image" and you'll come up with photos where people have said you can reuse them. Alternatively, you can buy yourself a pint and photograph it yourself

Could you just take a picture of it yourself?? Or check getty for ones release under GPL or Open-Source liscence !
It should be OK, since your girlfriend took the photo. (I don't think there are issues using a photo with a visible trademark in the way you did, but maybe one of the lawyerly types here can opine.)
I would say do it. If they send you a cease and desist then you know you have offended somone... But think about it, you are helping them with image advertisement. They probably would encourage it unofficially.
I don't see why you couldn't use it. I personally wouldn't hire you for that image. ( But thats just me ) It would make me think that you where drinking while you where doing the job. -- Don't get me wrong I love Guinness Stout but you want to convey a different image IMHO
