hi, i register the domain: xanga-help.info. and i setup a website for this domain. my site has about 2000 pages everyday now. but yesterday, a lawyer in xanga write to me that i should transfer the domain to Xanga.com, because xanga is their trademark. what can i do to protect my domain ? how long does it take for them to acqurie the domain ? thanks.
You can either fight the action or hand it over. I can't read the characters on your site, but their trademark registration is quite broad it'll be tough to show you have no intent to infringe their mark.
There is 277+ domain names starting with xanga with multiple extensions. View them here : http://domain-search.domaintools.co...=Search&bh=A&left=y&ordered=y&filter=n&pool=A Don't let your domain go easily. if you are not imitating xanga trademarked company and providing any services realted to their products, then you should not let it go easily. Answer them that this domain name belongs to you and you are not doing any business on behalf of them. Try to prove yourself right. If something goes serious Ask them you can get the claim on this domain if they comeup within ICANN rules, You can let it go only if ICANN advise him to do so. I do not remember exactly, but there is atleast $2250 application fee to ICANN to claim such trademarked domain names. So only serious calls will move to ICANN. .INFO is not a country TLD it's general, and TradeMark are on country basis, so it will not be easy for them to claim the domain.
You should not ask for money for them to "buy" it as that can be liable for cybersquatting, but you can say that it would incur a great deal of costs to buy a new domain and recover the lost traffic. I had a similar situation with a domain of mine and they offered me $3000.
You may have a problem. I don't read Chinese bit it appears that your site topic is related to xanga.com. I even see a xanga.com logo on one of your pages. If they decide to spend the $$ and take it to ICANN artibration they would very likely win. Your site is also registered with GoDaddy. GoDaddy is known to take back domains if trademark or copyright infringement is claimed. If, down the road, push comes to shove I wouldn't "give" it to them but would remove the content.
Some "interesting" comments I've seen here. I guess some of you are saying this and that because you're at some place you feel a trademark holder can't touch you?
