Can he sue me !!!

  1. #1
    If i buys a domain name with the .net and that particular name is sold to person under .com category, will it be legal or illegal.

    For example. one person owns techwhack.com and i buy techwhack.info and techwhack.net as it is available in the market.

    Will it be a legal under cyber laws.

    I dont see why it wouldnt be legal unless they have techwhack trademarked.

    If they do trademark it and it appears that you bought the domain for the sole purpose of making money off of their name, then they can sue and demand the domain. Just don't be a blatant ripoff of them, and you should be fine. They might even try to buy you out.

    As above, it is more complicated simply than if they have the trademark or not.

    If you are passing off - ie intentionally making money by people mistakingly going to your site rather than the other site - then they can sue for loss of earnings and have the domain seized

    If you are passing off will depend on how different the operations are from the original site. My previous employer successfully sued many sites that owned common miss spellings of their domains and were simply using the domain to have affiliate links to their competitors.

    I think it's perfectly legal as long as the person who bought the non .com name, of a trademarked service is pretending to be the actual trademarked company.
    I mean, if someone bought John.com and you bought John.org because your name is John, why would it be illegal? Now, if John.com was a company, and John.Org was pretending to scam people that it was John.com then yes, I think that would be unlawful.

    Its fine unless trademarked hence people often check all the extensions of their favored domains just in case it is available in something other thamn a .com.

    You can't purchase the domain with the sole purpose of selling it to them for money though.

    I had a .net of a .com and they bought the name for a VERY reasonable amount of money :) worked well for me, but may not always be the case.

    A reality that's lost on some people for some reason. But I guess that doesn't
    matter to those residing in countries that don't see eye to eye with the US.

    I'm rather disappointed with some of the posts here, although not surprising.
