Can Anyone Help with Advice or Legal Action?

    Someone else is using my name on Google and posting a premium rate number that isn't mine while the links to my site have been removed. We rate among the top two in the search engine and I want the other person's piracy stopped.

    what do you mean by "the links to your site has been removed"?

    send them a letter threatening legal action if they don't stop using your name

    Thanks for replying. the part that you click on, i.e. new age promotions, or telephone-psychic.com don't work. And, of course, when people can't use the links to access the website, they'll phone the telephone number which heads the second mirror ad, which isn't mine!

    Google doesn't show the telephone number but when you go to Ask.com it starts with a telephone number. I've put in a complaint now to their feedback section and suppose I'll just have to wait and see what happens. Thanks for your response Seo, I was just so angry at the cheek of someone doing that ....only saw red.

    :) I'm stunned and delighted with the support I have received. To Seo Ranger, the man12468, Tamar, submitmaster ...you've really given me a boost during my climbing the walls sessions. And someone - as even posted my plea on the search engines listings which has taken away some of the feeling of powerlessness. I stumbled on this site and I'm so glad I did. I've had a look at the links some of you have sent me and I'm just fascinated by it all. A whole new community and a bunch of new friends. I've still got to sort this mess out with the lines and the site but the moment I can think straight again I'll be back on here and joining in with the comments. What a find this site is!     Can I just add - because I think it's important. Google is the ONLY one that hasn't used the premium rate number in the heading. I take my hat off to them! The others, Ask.Com and Excite don't seem to think it odd that an entry starts with a premium rate number and none of the links work. Jan

    Just thought everyone would like to know the progress. I've now contacted a lawyer and the links that should be directed to New Age Promotions at devprint.co.uk (both my companies) from telephone-psychic.com lead to Easy Space. I got the dot com name from Iomart four years ago and the contract ran from November to November. According to ICANN the contract doesn't run out until November but Easy Space are not only still using a wrong premium rate on Ask.com and Excite - they are using links from New Age Promotions and using my wording to take people to a page advertising other psychic services. It costs people 60p per minute to ring it and was a chat line that allowed more than 10 people to be on at the same time! I'll keep you all posted.

    Well, could you really take legal action against him for using a name? Is it like a forum username? I don't really understand. If it's just a forum username, really anyone could use any name they want; what if his name was Jan Chambers? Nobody knows or can prove that. What if he just felt like using it? Even if he did do it on purpose he can still use any forum username.

    But I don't understand this completely, so..

    Hi I've just discovered your reply. He is not using merely a name but a premium rate number that he was told to take down two years ago because I couldn't use it and got rid of it. He was paid to push my rankings using the name telephone-psychic.com - handsomely. That link pointed to my main site at devprint.co.uk which incorporates another company of mine New Age Promotions. When I initially complained the link led to nothing. A day later it led to this company's website and advertisements for other psychics. My lawyer tells me it's blatant breach of contract and passing off. I'm fuming, to put it mildly. Not only that but my contract was with a company called Iomart which now appears to be Easy Space, UFindUs, Internetters, RapidRank, you name it, they're named it. This company was paid handsomely to push my rankings and they have no right whatsoever to use what I've paid them to do to pass off trade to competitors. They can have the dot.com name but to publish a phone number, a premium rate that costs 60p a minute (times up to 20) as it's a chatline, which they were asked to take down two years ago because it doesn't belong to me, and to get it put in search engine listings, is malicious damage.

    The link in question is now pointing back to devprint.co.uk, which is what I paid for. I'm seeing my lawyer tomorrow to find out if I can talk to the people who directed it elsewhere. I would have gone nuts, I'm sure, if I hadn't had this forum for support. You allowed me to see that I'm not the only one with domain name issues, etc. Thank you all so very much. I'll keep you posted when I hear what the lawyer has to say. Jan
