Business Name being used (without permission) on copied site.

    There is a website floating around the web that has managed to some how gain a copy of one of my old website's templates. Now I have been managing websites, and also creating websites, for a few years now. Though I am no expert in the field, I do know how easy it is for an individual to take content without asking for permission. That being said, this individual has not only stolen the template from the website but he is also making use of MY business name in the website’s footer! He probably took the template from the ground up and didn’t want to make any changes (aside from updating the adsense information and throwing in some new links to other websites). That being said, I am not a happy individual.

    What can I do in this situation?

    I have tried contacting the individual directly through any email means possible. I have also tried contacting the hosting company, but they too have proven to be of no assistance. At this point I am wondering what other venues could be exhausted? Should I consider getting a cease and desist ready?

    Send a cease and desist directly to the hosting company in regard to that site, with a deadline for them to respond. Hopefully they're in the US :( otherwise, that's a whole other problem.
