If they have a copyright on them, its technically illegal, but nobody will really do anything.

Then it wouldn't be illegal. But as I sayed, if it were, nobody would do anything at all.

Just because you got them for free doesn't mean they're not copyrighted and you're allowed to sell them.

That depends on the license under which they were published. Go back to the sites where you got them from and check for the license. Or ask the creator.

You're not allowed to sell them, doing so would be illegal.
People spend a lot of time making them so they can please users by offering them for free, if somebody just comes along and starts selling them it would be really unfair because the creators are the ones who deserve the money.

I don't think you should ever sell anything you didn't make, that's the only way to prevent copyright issues :)

If you didn't make it, you can't sell it.

If you want to make money from your collection then make it available for free on-line and put AdSense on the web-site.

I've collected around 80,000 ringtones and put them all up at http://www.freeringtoneheaven.com and http://alt.freeringtoneheaven.com

That's pretty much how most people do it. If you want to get in on the market then you need to provide a web-site that makes it easy to find what you're looking for and makes it easy to get onto your phone. My web-sites are proof that even terrible web-sites can make a nice amount of money.

Nobody is going to pay anything for a CD full of random files. How is the average person supposed to find what they want on the CD and upload it to their phone? How are they even supposed to know that what they want is on the CD?
