Bought a site but the owner doesn't actually own it...

Hi guys I got kinda ripped off. I bought a site for $500 and it turns out that the guy I bought it from doesn't actually own the domain (although he runs the site). His partner that I had no idea about owns the domain. I talked to his partner and he didn't know the site was sold. So basically this guy tried to rip off his partner and ripped me off. Now this guy is a Verified Non-Us paypal member.

After his partner talked to him he agreed to send the money back minus $50. So he wants a $50 fee for ripping us off.

Now my question is should I try getting all the money through paypal disputes or should I cut my losses and take the deal? Has anyone ever dealt with paypal disputes? Can they work in your favor?

    Thanks

I would talk to paypal about it, if they have the money in their account still, paypal will get it back for you.

The transaction took place on Sep. 9, 2006 so he might have withdrawn the money to into his bank account

What I personally would do, would be to get the $350 then claim for the $50 because he didn't refund the full amount. If he doesn't pay up, his account will be suspended until he pays.

I would take what was offered, and once it hit my paypal account, transfer to my bank account.
Then file a dispute about the difference with paypal.
If you kept all emails about this, the original sales information, etc.
Then give paypal all this information.

Heck, I would ask for my entire money back (don't tell paypal they paid part of it).

Then let the world know of this scammer!
Because I guarantee his partner was in on this scam!

Did you buy here on DP?
If so, let us all know who it was so we can avoid him like the plague...

The plan fsmedia has sounds like the best thing to do. Get what you can now and then deal with the rest later on.

In case paypal charged $500 to your credit card, you can do a chargeback

OK after talking to the seller he agreed to send me a refund, BUT his funds are frozen because I opened a dispute. Can he still use the refund link? He says that he can't because of the dispute but I want to make sure. If he can't is it safe to close the dispute?

He should have an e-mail from paypal telling him how to do it.

NO - DO NOT CLOSE IT - once you close it, you'll be unable to open it again & the seller can keep the funds. The seller is able to refund the payment to close the dispute easily.

sllik do not close the dispute lol, his funds are frozen and paypal will automatically send them to you... he has the option on the dispute that says "refund the money" so all he has to do is click that and it wont matter his funds are frozen... in time paypal will do it automatically and ull have all ur money back even if he doesnt have enough funds.. if h e doesnt have enough funds paypal will make his account negative and pay you from their own pocket i suppose.

If you close the dispute you are pretty much saying that its over and you have no right to those funds whatsover.

If he has the money in his paypal account and yours is the only open dispute he should be able to refund you by either clicking on "resolve now" or emailing the account review time and authorising them to refund.

If he is asking you to close the dispute:

    1) He has no intention of Refunding you
    or
    2) He doesnt have enough funds in the account
    or
    3) There are more complaints open against him than he has funds for

Dont close till you get your money back, give paypal Hell! Call them and ask to speak with a supervisor@
