Is a blogger bound to same legalities as a media agency for minors? The reason I ask is there is a blogger posting about a 12 year old girl who just died in Texas and mocking her death with her picture alongside of the mockery. This blogger is usually pretty over the top and is the owner of the abuse address so they wouldn't take any polite suggestions to remove it. oneangryguywithawebpage dot com/node/359 is where the mockery occurs, just wondering if there are any legal rules he's in violation of, or if it falls under moral decision instead
I think this site is absolutely wrong! Look at the WPWW picture at the left! Isn't that even illegal?
That's a logo for Stormfront, a white "advocacy" group he's a member of. Unfortunately groups like that are protected by the 1st amendment, though I hardly see how having any group that preaches hatred can be legal.
It seems like the freak that own that site is full of pure hatered. Forget if the picutres are legal, is the whole site even legal?
I dont even want to look at this site if it contains what you describe. Who can we report these things to, police i assume?
In the US we have a thing called free speach. Being angry and rude doesn't make it illegal. I say just move on and not let it bother you. If you let it bother you, he has made his point.
I'd have to agree. The worst thing you could give this guy is a forum post or a link so that more people visit the site.
If you're looking for a cause of action, intentional infliction of emotional distress might be an option, though that can be hard to show (i.e. the elements may be difficult to satisfy).
