    dealing with cheater is normal thing in DP. just need to be really sure and know how to safe yourself. Most importatn thing is dont fool yourself and make yourself look like an idiot orelse instead of people will support you but they will not deal or doing any business with you in the future. Bad reputation is hard to gain back. ;)

    Ok Guys – Hold on – Sorry for the long post – but in case you don’t want to read all of this – please just read the below 3 paragraphs:

    I can understand why ezguy is so mad. This guy just did the same thing to me. The difference this time is that he did it to someone who’s able to do something about it.

    I’m working with my counties Internet Fraud & Crimes Unit. Normally these types of crimes with low dollar amounts aren’t prosecuted because it will cost you (or the county or state) more than you lost to pursue it so people just get frustrated, mad, look at it as money gone and just give up. Unfortunately these people know that and until something is done to change this they will keep doing it. However, when you can prove a pattern of deceit or fraud it makes it much easier to prosecute – which is the case with this individual.

    Fraud paperwork is currently being prepared for submission to the Michigan State Attorney Generals office. I have also contacted some people that put me in touch with a local attorney in his hometown. I’m having him file a small claims court case against him. Getting your money back would be nice, but in all likelihood you’ll never collect even if you win - the reason for this is to obtain a judgment against him. Since this is a public record you can post it on the web and any sites that he frequents to warn others about him – basically as an annoyance factor that will follow him throughout cyberspace.


    So - if anyone here has any documented evidence of fraud concerning any transactions with this individual please PM me and I will gladly add then into this case file.


    (I also checked his itrader – thought it looked ok and went with him. Problem was I didn’t check far enough. The problems don’t seem to be when you’re buying something from him but when you’re procuring his “services.” I have found this same situation on many other sites.

    Right now this guy is registered on Digital-Point as Wishbone1 and Robb.

    The below details not only my situation, but others that you can also find info about him on, talkfreelance, wickedfire, youngentrepreneur, and other web related forums and under Cre8tiv-vision, Viccore Media, RobbDevore.com, Viccore.com, dollarexposure.

    This seems to be the common story on how this guy operates:

    - You post for a designer
    - He responds & says that he can get the job done in 24-48hrs
    - You finalize details and schedule
    - He responds that he needs payment of at least ½ of the job to start – fair enough
    - Communication is good up to this point
    - Now all of a sudden – communication stops – no responses to any communications
    - Days later you may get a response with excuses as to why your job wasn’t completed (of course you can’t even prove that it was ever started)
    - When a refund is demanded he promises that you will get it “shortly” or “in a couple of days”
    - Of course you never get your money back


    (In the interest of space I have only included a couple of communications concerning this – however If anyone needs to see all of them I would be more than willing to provide all messages).

    Below is a copy of the first response to my ad on DP:

    Hello,
    My name is Robert. I would love to design this project for you. I looked over the websites you mentioned and believe that I could create what you need for the job.

    I looked it over and thats the one I saw. I didn't look to close to see it used Joomla when i originally looked at it though. So, what would I need to do as far as work goes on this project for you?

    Design
    Code into valid xhtml/css

    Correct? If so, I can do this job for $225.00 and have it done for you within 24 hours from now. Design sample would be sent before the day is over though for sure and coding would be complete tonight/tomorrow.

    Let me know and we can begin today. As I stated before I do require 50% deposit to start the project and 50% on completion payable via paypal. So, 110.00 to start and 115.00 when finished.

    (Ok – now he’s been paid $115.00 and all details agreed to. I checked his feedback on DP – didn’t seem bad so I went against my better judgment and paid it – unfortunately I didn’t check other sites. He was also made aware that the due date for this project could not slip as this was a delivery date to my customer. I thought 24 hours was a stretch, even though that’s the time he quoted - so I gave him 4 days to complete the site and deliver it.)

    NOW AFTER THIS - NO DELIVERY MADE, NO RESPONSE TO ANY COMMUNICATION, ALL OF A SUDDEN HE HAS FALLEN OFF THE FACE OF THE EARTH.

    My e-mail to him two days after the deadline:

    Robert,
    You said you could have the job done in 24-48 hours - I gave you double that time and you still didn't get the job done.

    ($115.00 deposit paid - balance payable on delivery of functioning
    website. Buyer will be able to verify site design and functionality prior to final payment. DELIVERY BY 10/01/07).

    Do to your failure to meet the terms of our agreement or respond to my e-mails for status I have now missed my delivery to my customer. Because I wasn't able to deliver the site you were supposed to deliver to me I had to refund their money. I paid you what you asked for in good faith and I now expect a refund from you in the amount of $115.00 back into my Paypal account by 10/3/07.


    His response 4 days later:
    Hello,
    I just got into my new house and was in and out as far as internet access. I have the website coded out. I'll write you shortly and let you know the status of the refund.

    My response – same day:
    Robert,
    What does "shortly" mean to you - 2 days? 10 days?; and "let you know the
    status" - well that doesn't sound like "I refunded the money and it's in
    your PayPal account. Don't care or want to know about the excuses, your
    move or anything else.

    I checked my Paypal account and the refund wasn't there - so at this point
    I can only assume that you have decided to put me to the test - well, ok
    then.

    Good news:
    You got $115.00

    Bad News:
    Here's what's now going to happen:
    -filing a PayPal dispute tonight
    -filing a charge back on the credit card tonight
    -I'm working with the Counties Internet Fraud & Crimes unit here – you have now just become my number one priority
    -tomorrow I'll be filing fraud paperwork with the IC3 and Michigan Attorney Generals office
    -this will also cover Cre8tiv-vision, Viccore Media, RobbDevore.com, Viccore.com, dollarexposure, etc, etc, plus we will be contacting everyone
    from digital-point, talkfreelance, wickedfire, youngentrepreneur, and any
    other related forums to obtain posts and statement from users on how you've been operating.
    -I'm also going to contact some people that I know up there and ask them to hook me up with a local attorney and have them file a Small Claims lawsuit there against you - don't care if it costs me more than you got from me - it will be worth it so that there will be a court judgment against you that other people can and will find on the net.

    I said shortly because I currently do not have the cash in my paypal account. I need to get money added into my account to refund you the money. I do plan on refunding you the money in a couple days. I will email you before Sunday evening with the 115.00 back to your account.

    Which Brings us to today

    Against my better judgment I held off posting here just so that he couldn’t come up with another excuse (blame the victim) such as – well I offered to give you a refund if you didn’t post but since you did now I’m not refunding, etc, etc.

    So no surprise when as of today, no refund and no response to any communications.

    Sorry for the long post and again - if anyone here has any documented evidence of fraud concerning any transactions with this individual please PM me and I will gladly add then into this case file.

    well he pmed me when i asked for a site i said money on completion which he agreed and when i payed him after completion i got my site as promised in the time limit and also he installed it for me free as i dont knw how to do that and 50 dollars is not much and i got my product in ample time
