with any registrar I've used if the domain is going to expire within a month you will have to renew with your current guys, and then once the renewal takes effect you're free to initiate a transfer somewhere else.

according rules yes you can transfer. but some dodgy registrars can place lock and make forcibly to renew with them
In my own experience, I've started a transfer process within the very last week before expiring, once with one day left, and transfers were successful. Here is how it worked for me: Transfer process was initiated by the new registrar Depending on the your old registrar the acceptance time In the mean time domains may expire and display the expiration landing page Transfer process continued on the background and finally succeeding after a few days. With Godaddy it's almost immediate in and out and it has been GoDaddy, MyDomain, Dynadot and Domainsite the registrars I will be playing with in last-minute transfers
If your domain is expiring within a month, you must renew it with the current registrar.. and you better not transfer it to different registrar.. But you can Move the domain from one account to other account under the same registrar (domain Push or Move). If you have renewed the domain recently, its better to wait for a month before doing a domain transfer.
