I seem to always be able to find answers at digital point so here we go: One of my sites has been down all day. I recently upgraded the package thinking it would fix the problem (had a tendency to be down often), but obviously not, its actually worse. Package was upgraded two days ago, so here is my question: how much time is given as protection in Australia to consumers that want to be refunded? In Canada we are talking 10 days. Does anyone know how many days in Australia? Thanks.
I don't know how many days, but there is some interesting information in the Official site of the Ministerial Council on Consumer Affairs
legally there is no statute of limitation on this. It is down to the sellers discretion. However if the product is faulty you have usually 7 days to get a refund legally. However you must determine it is faulty and something different to that which has been described in the product description. Also you should check that the servers are actually in Australia! If it is an Australian site and you are accessing it from canada, it may not be that the server is actually down, it may be that the link between north america and Australia is down, which happens more often than it should. Basically your first course of action is to discuss it with the providor. If that yields no results, then you need to have a look at all the fine print, make sure they are breaching them and then report them to the ACCC or the ombudsman, however not being a citizen may leave you with little joy. I would take the first course of discussing with them, take the second course of reporting them to consumer affairs or ACCC. Daniel
Thanks gentlemen. That is very interesting, I didn't know that. In this case however, it really is a problem with the server - about 1000 impressions daily when online, 20 today = loss of revenue
Not trying to be critical, but if the host had a tendency to be down why would you upgrade plans? Having server issues and running out of bandwidth aren't one and the same thing.
No offense taken. I bought the site it was already on the server and hosted until tomorrow. Second, this week has just been a bad week to be hunting for a new hosting company. Third, I am not very technical, I can barely code an html page, so I have been looking for someone to transfer the site and build the database, but again its a bad week to be doing this and none of the people I contacted came back to me. So I figured given the circumstances it was the best choice.
What kind of sites are you hosting? If their not too resource hungry I can set you up on my server to help you out initially. The servers are based in the US though. PM me if you like.
Thanks, but I decided to go with a dedicated server. Will just host everything on it. The site that is having problem is a google cheat sheet, so it offers a great little service... when people can reach it.
