Aren't general directory owners infringing on TM?

    Hi,

    YMC- Yeah I think you are understanding my question. Although, I'm more focused on the category listings, not necessary the listed sites. Here, let me give you a clearer illustration, maybe you can help me further.

    1. I'll pretend my directory is called the "Victoria Directory". It's a general directory.

    2.The Victoria Directory's main categories consists of Business, Health, Fashion, Games, & Music.

    3.Now would I be infringing on "Victoria's Secrets" since I have a category for fashion (assuming their name is TM for a fashion service/product)?


    That would be great if the worst that happens is if they ask for the infringing materials to be removed, which I originally expected. Although, how come some companies ask for the domain to be transferred? Is this the result of ignoring requests for removal of the infringing materials?

    If you don't mind I'll jump in here as it's what I'm qualified at so why not use it. :) The short and sweet answer is No you would not in this case be infringing trademark rights. If you want a more details explanation wait for the blog I'm opening up in the next week, it will help many people in this kind of circumstance.
