    it is ok 100% .... I mean it is header and then ads .... 90% sites has ads like that

    I think it's okay, as well - it's a fairly subjective matter, but this to me "plays" as page title, followed by ads, followed by page content. I could see how it could be a violation of the ToS if, for example, they placed a box around the title and ads. As it is, I doubt Google would take issue with it.
